Participation rules and data protection information

1. object
1.1 The following terms and conditions and information govern participation in the "FGC" competition, organised by Kulturkarawane gemeinnützige UG, Weidegasse 1, 54290 Trier and the collection, processing and use of the data provided by the participants in connection with participation in the campaign.
1.2 The "FGC" competition is not affiliated with Meta and is not sponsored, supported or organised by Meta. The recipient of the information provided by participants is not Meta, but Kulturkarawane gemeinnützige UG.
1.3 By participating in the "FGC" competition, participants agree to the following terms and conditions.

2. conditions of participation
2.1 The "FGC" competition will be held from 4 August 2023 at 18:00 to 11 August 2023 at 20:00.
2.2 All natural persons acting in their own name who are resident in Germany, Austria and Switzerland are eligible to participate. Employees of Kulturkarawane and its subsidiaries and their relatives are excluded from participation.
Only persons aged 18 and over who fulfil the admission requirements in accordance with section 2.3 and have confirmed the conditions of participation are eligible to participate.
Minors are excluded from participation.
2.3 The prerequisite for participation is that the participant follows the Kulturkarawane account, leaves a Like under the competition post on the Kulturkarawane page and links a person who should definitely be there.
2.4 All participants will be entered into a prize draw to win 3x 2 "all-in" tickets for the "Flying Grass Carpet" music and culture festival, which takes place from 18-22 August, worth 59 euros including welcome wine and an exclusive supporter button.
2.5 Kulturkarawane reserves the right to exclude persons from participation who violate these conditions of participation or who seek to gain or obtain an advantage over other participants by unduly influencing or manipulating the competition. Comments that violate the meta guidelines, Kulturkarawane netiquette and German law will be removed without prior notice. The participant is thus excluded from the prize.
In such cases, the organiser may also subsequently exclude participants from the competition, withdraw prizes and reclaim them.
2.6 The Organiser reserves the right to change or withdraw a prize. Any prize offered instead will have at least the same or a higher value than the original prize.
2.7 Participation in the competition expressly does not require the purchase of goods from the Organiser.

3. processing
3.1 A winner will be drawn at random from all participants who have fulfilled the requirements for participation under sections 2.2 and 2.3 during the duration of the promotion.
3.2 The winners will be contacted by Kulturkarawane on 12 August 2023 by direct message and asked to provide their first and last names for the guest list.
3.3 Payment of the prize in cash, in kind or in exchange is not possible. The prize is not transferable to third parties. The participant may waive the prize. Legal recourse is excluded.
3.4 If a participant does not confirm acceptance of the prize by 15 August 2023 at 18:00 by responding to the announcement in accordance with section 3.2 with a message informing them of the prize, the prize will be forfeited.
3.5 If the contact details provided by the participant are incorrect, Kulturkarawane is not obliged to determine the correct data. Any disadvantages resulting from the provision of incorrect contact details shall be borne by the subscriber.

4. availability of the competition and early termination
4.1 The availability of the "FGC" competition for the entire duration of the promotion cannot be guaranteed, as the competition takes place within Meta and Kulturkarawane has no influence on the (technical) availability of the platform.
4.2 Kulturkarawane reserves the right to interrupt or terminate the promotion at any time without prior notice or justification, for example for technical or legal reasons.

5. liability
5.1 Kulturkarawane shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
5.2 Kulturkarawane shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the "FGC" competition and on the fulfilment of which the participants regularly rely. In this case, however, Kulturkarawane shall only be liable for the foreseeable damage typical for the contract. Kulturkarawane shall not be liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
5.3 The above limitations of liability do not apply to damage caused by intent or gross negligence, to damage resulting from injury to life, limb or health, to a defect following the assumption of quality guarantees for the quality of a product and in the case of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
5.4 Under no circumstances will the Promoter be liable for any loss, damage or injury, however caused, suffered or otherwise incurred by the winner or any property in connection with this competition or any of the prizes awarded.
5.5 Insofar as the liability of Kulturkarawane is excluded or limited, this shall also apply to the personal liability of representatives and vicarious agents of Kulturkarawane.

6. data protection
6.1 Kulturkarawane collects and uses participants' data only to the extent permitted by law or with the participants' consent. The following personal data of participants will be collected by Kulturkarawane upon participation:
- First and last name of the participant

The data is collected, processed and used exclusively for the realisation and processing of the competition organised by Kulturkarawane.
6.2 Upon written or text-based request, participants may at any time request information about which personal data is stored by Kulturkarawane, and may request its correction and/or deletion, as well as revoke their consent to the use of their data.

7. notes on Meta
7.1 Participants may not assert any claims against Meta that arise in connection with the use of Meta or participation in the Promotion.
7.2 Participants acknowledge that the Promotion is not sponsored, supported or organised by Meta or has no commercial connection with Meta.
7.3 If postings are made on Instagram and Facebook, Meta's general terms of use and privacy policy apply.
7.4 Enquiries and comments regarding the Promotion should be addressed to Kulturkarawane at the e-mail address info@kultur-karawane.de and not to Meta directly.

8. severability clause
Should individual provisions of these conditions of participation be invalid or should there be a loophole, this shall not affect the validity of the remaining provisions. The invalid or missing provisions shall be replaced by a provision that comes closest to the purpose of the contract and the statutory provisions.

9 Applicable law
These conditions of participation are subject exclusively to German law.
